Could Ted Cruz end IRS 501-C3 Church political limits with Obama-style "Prosecutorial Discretion" such as Obama used to create Executive Amnesty for Illegal Aliens ?

Could (President) Ted Cruz effectively abolish the "Johnson Amendment of 1954" through "executive action" ?

POTUS Obama has claimed "Prosecutorial Discretion" to effectively create "Executive Amnesty".

The New York Times and prominent Liberals have defended Obama's actions as properly within Obama's presidential "Constitutional authority".


Senator Ted Cruz, in questioning U.S. Attorney General nominee Loretta Lynch, asked her a couple of questions to this effect:

Since Loretta Lynch and President Obama support the concept of expanded "Prosecutorial Discretion", would it be OK if a future president:

1) declined to enforce major portions of the IRS Federal Tax code ?

2) declined to enforce major portions of EPA regulations for the state of Texas ?



Nominee Loretta Lynch refused to even submit an answer to Ted Cruz's questions.

Now for the question at hand, the IRS enforcement of Church political activity restrictions (IRS 501-C3, et al) which were effectively created with the "Johnson Amendment of 1954" (see link below).


If it's OK for Obama to NOT enforce Federal Immigration Law, then wouldn't it also be OK for a future U.S. President to order the IRS to NOT enforce IRS 501-C3 (et al) ...

and allow U.S tax-exempt Churches to KEEP their tax-exempt status YET freely engage in political activity ?



What are your thoughts ?

With the stroke of a pen, Cruz could outlaw Federal employee unions. It was just an executive order of JFK's that permitted them. No President since has bothered—or dared—to reverse this EO.

It's long overdue. If someone did, it would just be too-bad-so-sad. There down the drain would go millions or billions of dollars, in illegal campaign contributions—both cash and in-kind—to the Evil Party. The Stupid Party has inexplicably failed to take this opportunity.

He certainly could. The Republicans ratified the precedent when they gave the president power to change laws or make new ones. Without an Article ̀ convention and it's success, that is where we are. We have to try to elect the person most apt to get goodies for our side.

Outstanding post, and yes it is true. But it raises a number of points. I think Ike and Truman were way-better than JFK, and I wonder how many freepers think JFK is so over-rated. Tangent to that is his successor LBJ, I wonder in terms of growing the welfare state and entitlements JFK put us in the mess we are in now and if we really look at it Carter is a piker compared to BHO and LBJ.

Or did LBJ, just run with what JFK would have done anyhow.

Fr-er historians please opine....

IMO, LBJ was able move the Great Society legislation because he had a martyred JFK to use as a club on congress.

JFK could not have gotten 20% of what LBJ did. In fact, JFK’s political clout was rather weak.

According to judicial scholar Robert Lowry Clinton in 'How the Court Became Supreme', prior to the Civil War, the Executive and the Legislative made primary Constitutional Interpretations, the Court's Constitutional interpretations were primarily concerned with issues about its own operations.

Nixon could have refused to enforce Roe v Wade and Doe v Bolton (1973), but he agreed with them.

I don't think we can assume any man could have duplicated LBJ's scale of flinty-eyed destruction. Not even 0bummer. The War on Poverty has kept generations of Americans—20 million or so at any given time?—in slavery, in whose name Washington labors to destroy the liberty of the rest of us.

JFK distrusted Martin Luther King and the Civil Rights movement with good reason: It was run by white Communists, of whom MLK was one of their major puppets. For a taste, search for King's 1967 speech where he comes out against the Vietnam war. He says a couple of anti-Soviet things, and then proceeds to endorse a good dozen Soviet-backed revolutions in Africa and South America while trashing the U.S.—calling our country "the greatest purveyor of violence in the world today."

I don't think JFK would have wound up duplicating Johnson's demographic apocalypse—the one that dropped America into the pit of socialism.
