As I said earlier, public intoxication is not illegal in this state so they had no grounds for a field sobriety test when they arrested her. I suspect they didn't find the gun until they got her to the station. At that point they asked her to take a Breathalyzer and she was within her rights to refuse. So they can't charge her with something they have no evidence for.

So she is carrying a weapon, is arrested, is said to be visibly under the influence of alcohol, but the cops can't get a blood test drawn after taking her into custody without a special court order,solely because she refused to take a field sobriety test?

That's not making any kind of logical sense to me.

Mostly laws have a decent degree of logic attached to them.

I'm not buying this story at all, that she could be arrested and not tested.

You have that backwards. She was arrested and only afterwards was found to be carrying. She wasn't issued a field sobriety test because there was no reason to. And once arrested you have the right to refuse to cooperate with the police. You don't have to answer questions. You don't have to provide a blood sample. You don't have to take a Breathalyzer.

That's not making any kind of logical sense to me.

Don't confuse what police can do when they suspect you of DWI with what they can and can't do under other circumstances.

The law is the law.

Even people like her have Constitutional rights.

Missouri does not require ccw holder to notify le while carrying, but if being arrested it would be foolish not to as one might get shot. intoxication and carrying only applies if mishandle weapon while intoxicated..

it is standard police procedure to search for weapons before placing arrestee in police car or transporting them not to do so is mistake of highest order.

Well I doubt that Jamilah Nasheed is the sharpest tool in the shed under the best of circumstances. So it wouldn't surprise me if she didn't tell them she was carrying when arrested.

No mention that conceal carry was legal there.Open carry yes, concealed carry, no.

Did the drunken State Senator have a permit to conceal carry a weapon or not?

Concealed carry is legal in this state with a permit.

Did the drunken State Senator have a permit to conceal carry a weapon or not?

She says she does. I haven't seen any reports she was lying about it.
