While I agree with you on the other points, I have to disagree here. Perhaps in the eyes of God they weren't married but in the opinion of the court they were at least assumed legally married or the court would not have heard the divorce pleading. The court demands signed and sealed documents so there had to be something she showed the judge. Known bigamy = annulment. Believed marriage = divorce.
